1. About these terms
These terms govern your use of the SmartRebate website (smartrebate.co.uk) and the introducer service it provides. By submitting an enquiry through our website, you agree to these terms.
SmartRebate is a lead generation and introductory service, it does not offer financial advice. References to "we," "us," and "our" mean SmartRebate. References to "you" and "your" mean the person using our website or service.
2. What SmartRebate is and is not
SmartRebate is an introducer service. We connect UK PAYE workers who may be entitled to a tax rebate with a regulated accountancy firm (the "Accountancy Partner") that processes such claims.
We do not:
- Process tax rebate claims ourselves
- Provide tax, accountancy, financial, or legal advice
- Submit any application to HMRC on your behalf
- Receive, hold, or handle your rebate funds
- Act as your agent in any dealings with HMRC
We are not regulated by the Financial Conduct Authority. We are not an accountancy firm, a tax adviser, or a regulated financial service provider.
3. The Accountancy Partner
The Accountancy Partner is a separately regulated firm that operates independently of SmartRebate. They are responsible for:
- Assessing your eligibility for a tax rebate
- Calculating the amount you may be owed
- Submitting your claim to HMRC
- Communicating with HMRC on your behalf
- Receiving your rebate from HMRC and paying it onward to you (less their fee)
The contractual relationship for the rebate claim is between you and the Accountancy Partner directly. SmartRebate is not party to that contract. You will be asked to enter into a separate engagement letter with the Accountancy Partner before any claim is submitted.
4. Our role
Our role is limited to:
- Reviewing your initial enquiry
- Confirming your basic eligibility
- Introducing you to the Accountancy Partner
- Facilitating communication where helpful during the onboarding stage
Once your engagement with the Accountancy Partner is in place, the Accountancy Partner is solely responsible for the conduct, quality, and outcome of your claim.
5. Fees and payment
Our service to you is free. You will not be invoiced or charged by SmartRebate at any stage.
We receive an introduction fee from the Accountancy Partner when a successful introduction is made. This fee is paid by the Accountancy Partner, not by you, and does not affect the amount of your rebate.
The Accountancy Partner charges a fixed percentage of any successful rebate, deducted from the rebate before it is paid to you. Their fees, payment terms, and refund policies are set out in the engagement letter you will sign directly with them. SmartRebate is not responsible for the Accountancy Partner's fees or any disputes regarding them.
6. No guarantee of outcome
We do not guarantee:
- That you will be eligible for a rebate
- The amount of any rebate you may receive
- The time taken for HMRC to process your claim
- The success or outcome of any claim submitted by the Accountancy Partner
References on our website to average rebate amounts, success rates, processing times, and similar figures are based on data provided by our Accountancy Partner and reflect historical averages. They are not promises, predictions, or guarantees of any individual outcome.
7. Limitation of liability
To the fullest extent permitted by law, SmartRebate's liability to you is limited as follows:
- We are not liable for the conduct, quality, accuracy, timeliness, or outcome of any work performed by the Accountancy Partner.
- We are not liable for any decisions, demands, calculations, refunds, or other communications issued by HMRC.
- We are not liable for any loss arising from your decision to proceed (or not proceed) with a claim.
- We are not liable for indirect, consequential, or special losses, including loss of profit, loss of opportunity, or loss of anticipated savings.
Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under UK law
Where our liability is not excluded, our total liability to you under or in connection with these terms is limited to £100.
8. Your responsibilities
You agree:
- The information you provide to us and to the Accountancy Partner is accurate, complete, and not misleading
- You have the right to claim any rebate you are applying for
- You are not currently in dispute with HMRC over the matters being claimed
- You will respond promptly to requests for information from the Accountancy Partner
- You will not use our service for any unlawful or fraudulent purpose
Providing false or misleading information to obtain a tax rebate may be a criminal offence. We may decline to make an introduction, or withdraw an existing one, if we have reason to believe information provided is inaccurate.
9. Complaints
If you have a complaint about SmartRebate's service, please contact us at hello@smartrebate.co.uk in the first instance. We aim to acknowledge complaints within 5 working days and respond fully within 20 working days.
Complaints about the Accountancy Partner's service should be directed to the Accountancy Partner using the complaints procedure set out in your engagement letter with them.
10. Data protection
Our handling of your personal data is set out in our Privacy Policy at smartrebate.co.uk/privacy. By submitting an enquiry, you consent to your details being shared with the Accountancy Partner for the purpose of assessing and processing your potential claim.
11. Intellectual property
All content on the SmartRebate website (including text, graphics, logos, and design) is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use this content without our written permission.
12. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the website after changes are posted constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
